Terms and Conditions

All dealings with Pacific Edge Guides will be bound by these Terms and Conditions (Terms) unless otherwise agreed in writing with Pacific Edge Guides.

 

Cancellations or Changes by Participants

Pacific Edge Guides has the following cancellation policy:

  • Bookings can only be cancelled by the Participant by giving written notice to Pacific Edge Guides

  • Bookings cancelled between 0 to 24 hours before the tour are not refundable

  • Bookings cancelled 24 hours to two weeks before the tour require 50% payment

  • Bookings cancelled more than two weeks before the tour will have of the full tour price refunded (less any non-refundable booking deposit)

 

Cancellations or Changes by Pacific Edge Guides

If the minimum number of participants for tours is not reached then Pacific Edge Guides reserves the right to change or cancel any bookings. Pacific Edge Guides reserves the right to cancel or vary this service in any way without notice. However, a reasonable effort will be made to maintain arrangements as advertised.

Pacific Edge Guides will not proceed should we decide that the weather makes the participation in the tour unsafe, or for any other reason, at the absolute discretion of us. If we cancel a tour we will endeavour to do one of the following:

  • Re-book you for another date or tour (subject to availability)

  • Provide a full refund

There will be no refund of a ticket by Pacific Edge Guides except in accordance with these terms or as agreed in writing by us. Refunds will only be made to the person who purchased the ticket from the Pacific Edge Guides

Participating in Pacific Edge Guides Walking Tours

All Participants acknowledge and agree that they participate in Pacific Edge Guides services at their own risk. All Participants are required to take reasonable steps to ensure their own personal safety on public and private land, and comply with New South Wales laws.

All Participants will be required to disclose to their Pacific Edge Guides guide prior to the commencement of all tours whether the participant experiences any medical condition which may prevent the participant undertaking the tour.

This include but is not limited to limb or back injury, heart conditions, severe asthma, epilepsy, dizziness, or recovering from recent surgery.

Timing & Itinerary

Pacific Edge Guides will always do our best to contact you by mobile phone if you are late or missing part of the tour. However, we accept no responsibility for, and provide no refund for, participants who miss any part of the tour for any reason.

We reserve the right to alter any part of the itinerary without notice before or during the tour as circumstances dictate. We will endeavour to communicate any significant changes in a timely manner but are not liable for any changes and are not required to offer any refunds as a result of any change.

Bookings

Gift Vouchers

  • Gift vouchers are valid for 12 months from the date of issue

  • Gift vouchers are non-refundable

 

Safety

By booking with us you acknowledge that participation in all our tours involves inherent risks that may not be present in other less demanding tours. These risks include, without limitation, the possibility of injury or death, psychological trauma, loss or damage

 

Behaviour

During Pacific Edge Guides walking tours we expect responsible, respectful behaviour from our participants. The guide may direct a participant without refund to leave a tour if they are rude, hostile or aggressive to the guide, fellow participants or the public.

 

Publicity

Pacific Edge Guides may ask your permission to use images or video of you taken during the tour. If you are we will use the images or video without recourse to you and without compensation to you, for publicity and promotion purposes only, through whatever medium we choose.

 

Privacy

Pacific Edge Guides will need to collect information from you, some of which may be of a personal nature, in order to provide a service. The information may be disclosed to, or collected on our behalf by our service providers to enable the services to be provided, but will not be used by them for any other purpose.

Guest Release and Pacific Edge Guides Liability

Each participant releases Pacific Edge Guides, its employees and agents from liability or loss or injury to the guest from any cause, and whether due to the negligence of Pacific Edge Guides or any other person. Each participant releases Pacific Edge Guides from all sums of money, accounts, claims, actions, proceedings, demands and expenses which the guest at any time may have against Pacific Edge Guides for or by reason or in respect of any act, cause, matter or thing.

Each guest indemnifies Pacific Edge Guides against:

  • All losses incurred by Pacific Edge Guides

  • All liabilities incurred by Pacific Edge Guides; and

  • All costs actually payable by Pacific Edge Guides to its own legal representatives (whether or not under a costs agreement) and other expenses incurred by Pacific Edge Guides in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any act or omission of the guest.

 

Pacific Edge Guides’ Discretion

Pacific Edge Guides may use its absolute discretion in exercising any of the rights granted to it pursuant to these Terms and Conditions.

Governing Law and Jurisdiction 

The law of NSW governs these Standard Terms and Conditions. The parties submit to the non-exclusive jurisdiction of the courts of NSW and of the Commonwealth of Australia.
